These Terms & Conditions (“Terms”) govern your use of CloudFace AI website, application, and services operated by Elephic Technologies (“we,” “us,” or “our”). By accessing or using our service, you agree to these Terms.

1. Our Service

CloudFace AI is an AI-powered face recognition tool that helps you instantly find people in your photo collections (primarily from Google Drive). We use advanced models (RetinaFace + ArcFace) and store photos securely with AES-256 encryption to enable fast searches and guest sharing.

2. User Accounts and Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use paid features. You are responsible for maintaining the confidentiality of your account.

3. User Content and Ownership

You retain full ownership of all photos and content you upload or connect.

By using our service, you grant us a limited, revocable, non-exclusive license to:

  • Process your photos using our AI.
  • Store them encrypted on our servers (AES-256 with per-user keys).
  • Create face embeddings.
  • Display search results and enable guest sharing as per your instructions.

We do not claim any ownership rights over your photos or embeddings.

You are responsible for ensuring you have the legal right to upload and process the photos (including consent from people appearing in them where required by law).

4. Prohibited Uses

You agree not to:

  • Use the service for surveillance, stalking, or any illegal purpose.
  • Process photos of individuals without necessary consent.
  • Upload illegal, harmful, or obscene content.
  • Attempt to reverse engineer our AI models or technology.
  • Resell or commercially exploit the service without permission.
  • Violate any applicable privacy or data protection laws.

Violation may result in immediate account suspension or termination.

5. Payment and Subscription

Paid plans are billed monthly or annually. You authorize us (via Razorpay or other processors) to charge your payment method. Prices may change with notice. Taxes (including GST) are additional where applicable.

6. Refund and Cancellation

Please refer to our separate Refund Policy, which offers a 30-day money-back guarantee on initial purchases.

7. Limitation of Liability

The service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

We are not liable for:

  • Inaccuracies in face recognition results.
  • Any indirect, incidental, or consequential damages.
  • Loss of data or business opportunities.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the service, violation of these Terms, or infringement of third-party rights.

9. Termination

We may terminate or suspend your account for violation of these Terms. Upon termination, you may lose access to paid features, but you retain ownership of your photos (subject to deletion requests).

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Gurugram, Haryana.

11. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.
